Terms of Use

These terms are the rules for playing Loco Motion, a Mexican Train dominoes game made by Sean Benedict, an independent developer in Texas, USA ("we", "us"). By playing or creating an account, you agree to them. If you don't agree, please don't use Loco Motion. Our Privacy Policy explains how we handle your information.
- Be kind. No offensive names, cheating or harassment.
- Tickets, passes and game items are just for fun inside the game. They have no cash value and can't be sold or cashed out.
- Accounts and online play are for people 13 and older, in the United States.
- We can remove accounts that break the rules. You can delete yours any time.
1. Who can play
- Anyone can play against the computer without an account.
- You must be 13 or older to create an account or play online with others. If you're under 18, a parent or guardian should review these terms with you.
- Loco Motion is offered in the United States only.
- Online play is currently by invitation: you join through an invite link from someone who already plays.
2. Your account
- Give a real email address you can access, and keep your password private. You're responsible for what happens on your account.
- One person per account. Don't share it, sell it or use someone else's.
- Tell us at support@playlocomotion.com if you think someone else is using your account.
3. Play nice
Loco Motion is a family game. When you play, you agree not to:
- use a display name or gift note that is offensive, hateful, sexual, threatening, or pretends to be someone else;
- harass, bully or threaten other players, or use reactions, invites, gifts or friend requests to annoy people;
- cheat: use bugs, scripts, modified versions of the game or anything else to win unfairly or to get tickets, items or rewards you didn't earn;
- try to break, overload, or get into parts of the service or other players' accounts that aren't yours;
- use Loco Motion for anything illegal, or to collect information about other players.
If someone breaks these rules, you can report or block them in the game, or email us. We review reports within 48 hours.
4. Tickets, passes and game items
- Loco Motion has virtual items such as tickets, Whistle Tickets, trains, tables, tiles, whistles, sets, Rail Pass rewards and gifts. They're a limited license to use them inside the game; you don't own them.
- Virtual items have no cash value and can't be exchanged for money, sold, or transferred outside the game. Gifts can only be sent to friends inside the game.
- We may change how items, prices, rewards, daily limits and passes work, or fix balances that are wrong because of a bug or cheating. We'll try to be fair about it and won't take away items because of an automatic flag alone.
- Items are tied to your account. If your account is deleted, by you or by us under section 6, its items are gone and can't be restored.
- Loco Motion doesn't currently sell anything. If we ever offer purchases, they'll be handled by the app store you use (for example Apple or Google), and all sales are final except where the app store's rules or the law give you a refund. Refund requests go to that store. We'll update these terms before purchases are offered.
5. Your content
The only things you type that other players see are your display name and gift notes. You keep any rights you have in them, and you let us store and show them inside the game so it works. We may change or remove a name or note that breaks these rules.
6. Suspending or ending accounts
- We may rename, suspend or delete an account, or remove items, if it breaks these terms, puts other players at risk, or if the law requires it. Where it's reasonable, we'll tell you why.
- You can stop playing at any time and delete your account from Settings or your Profile (see our Privacy Policy, section 8).
- We may change, pause or stop Loco Motion, or any feature of it. If we shut the game down, we'll try to give notice in the game first.
7. Our game
The Loco Motion game, its art, sounds, names and code belong to us or the people who license them to us. You may play it for your own personal, non-commercial fun. Please don't copy, resell or reverse-engineer it.
8. No warranties
Loco Motion is provided "as is" and "as available". We work hard to keep it running and fair, but we can't promise it will always be available, error-free, or that saved progress will never be lost. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
9. Limit of liability
To the fullest extent the law allows, we won't be liable for any indirect, incidental, special or consequential damages, or for lost data, items or progress, arising from your use of Loco Motion. Our total liability for any claim about Loco Motion is limited to the greater of the amount you paid us in the 12 months before the claim or US $10. Some places don't allow these limits, so they may not all apply to you.
10. Apple and Google
If you get Loco Motion from an app store, these terms are between you and us, not the app store. The store's own terms also apply. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you, but Apple has no responsibility for the game, its support, or any claims about it.
11. Texas law
These terms are governed by the laws of the State of Texas and applicable US federal law, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Texas, unless the law where you live says otherwise. Before filing a claim, please email us so we can try to sort it out.
12. Changes to these terms
We may update these terms as the game changes. We'll change the "Last updated" date, and for significant changes we'll tell you in the game before they take effect. If you keep playing after that, you accept the new terms.
